Sgt. Kevin Benderman Legal Defense Fund

Sgt. Kevin Benderman is a 10-year veteran of the US Army, with honorable service and a combat tour in Iraq. After experiencing war firsthand, Kevin returned home to reflect on his experiences. After careful consideration Kevin determined that he could no longer participate in war and took the legal course available to him, filing a Conscientious Objector application based on his moral and ethical beliefs.
His command refused to accept his application violating military regulation in the process. As punishment for his outspoken stance against war, Sgt. Kevin Benderman, in a US military court, was convicted of Missing Movement and sentenced to 15 months confinement, loss of pay, reduction in rank and Dishonorable Discharge.
A dedicated soldier turned against war for moral and ethical reasons, based on his real-life experiences, who our government punished by taking away his freedom and his right to vote. A well-respected attorney, noted for his expertise in Military Law, has agreed to represent Kevin in his Appeal against the US Army.
Kevin Benderman’s case has significant merit for all individuals who believe in every American citizen’s right to Freedom of Choice and Conscience, one of the founding principles of our country’s Constitution. Since his CO claim was wrongfully denied, his imprisonment should end.
This case will also impact the discussions now taking place involving
changes in legislation that will give all soldiers the right to declare
their Conscientious Objection to specific wars of aggression, conflicts that violate the peace, and any illegal, immoral action as defined by the Nuremberg Tribunals without fear of retribution from the US Military for their stance. As such, the case has the potential for impact on a broad national and international scale.
